Sanctions Policy
Food Prepped provides a direct connection between buyers and sellers around the multi-nationally. When you use Food Prepped’s services (we’ll refer to Food Prepped.com, our mobile apps, and other services as our “Services”), you are accountable for conforming with this Sanctions Policy, irrespective of your location.
This Sanctions Policy is a part of our Terms of Use. By using any of our Services, you agree to this Sanctions Policy and our Terms of Use.
As a multi-national company based in the UK with operations in other countries, Food Prepped must comply with economic sanctions and trade restrictions, including, but not limited to, those implemented by the Office of Financial Implementation (“OFSI”) of HM Treasury. This means that Food Prepped or anyone using our Services cannot take part in transactions that include designated people, places, or items that derive from certain places, as determined by organisations like OFSI, in addition to trade constraints imposed by related laws and policies.
This Sanctions Policy applies to anyone that uses our Services, irrespective of their whereabouts. It is up to you to familiarise yourself with these constraints.
For instance, these restrictions usually prohibit, but are not limited to, transactions involving:
- Certain geographic areas, such as Crimea, Cuba, Iran, North Korea, Syria, Russia, Belarus, and the Donetsk People’s Republic (“DNR”) and Luhansk People’s Republic (“LNR”) regions of Ukraine, or any individual or entity operating or residing in those places.
- Individuals or entities identified on sanctions lists such as OFSI’s UK Sanctions list
- Goods, services, or technology deriving from Donetsk People’s Republic (“DNR”) and Luhansk People’s Republic (“LNR”) excluding qualifying informational resources and agricultural products such as food for humans, seeds for food crops, or fertilizers.
To protect our community and marketplace, Food Prepped takes steps to ensure compliance with sanctions programmes. For example, Food Prepped prohibits members from using their accounts while in certain geographic locations. We may suspend or terminate your use of our Services, if we are given reason to think you are managing your account from a sanctioned whereabouts. This includes any of the locations listed above, or are otherwise in violation of any economic sanction or trade restriction.
Members are usually not allowed to list, buy, or sell items that originate from sanctioned areas. This includes items that pre-date sanctions since we have no way to prove when they were removed from the regulated location. Food Prepped reserves the right to request that sellers deliver further information, divulge an item’s country of origin in a listing, or take other steps to meet compliance requirements. We may deactivate listings or cancel transactions that present a risk of infringing this policy.
In addition to conforming with OFSI and significant local laws, Food Prepped members should be aware that other nations may have their own trade constraints and that certain items may not be permitted for export or import under international laws. You should confer the laws of any authority when a transaction involves international parties.
Finally, Food Prepped members should be aware that third-party payment processors, such as PayPal, may independently monitor transactions for sanctions compliance and may block transactions as part of their own compliance programmes. Food Prepped has no authority or control over the independent decision-making of these providers.
The economic sanctions and trade restrictions that apply to your use of the Services are subject to change, so members should check sanctions resources regularly. For legal advice, please consult a qualified professional.
